Within the frame of the Law on the Right to Information, the Association received a total of 18 inquiries during 2017. Out of these 18 inquiries, positive responses were given to nine, which were provided with access to information and documents. Access to documents and information was granted to two, which were partly responded positively and partly rejected, while two applications were rejected. Five applications were referred to other institutions and organizations due to their relevance. Oversight The Association is authorized and assigned to regulate, supervise and enforce issues delegated to it by legislation or by the CMB. In this context, various audits are conducted when necessary, and the provisions of the legislation are applied in case of non-compliance. TCMA Client Dispute Arbitration Committee The Statute of the Turkish Capital Markets Association charges our Association with the duty to “assist in the resolution of conflicts which may arise among the members or between the members and their customers from transactions other than exchange transactions; set up the arbitration committee and the necessary infrastructure subject to the procedures and principles that will be drawn up for this purpose and approved by the CMB”. The Turkish Capital Markets Association Client Dispute Arbitration Committee reviews and resolves the disputes which arises from or in relation to capital market activities other than exchange transactions among the Association members engaged in capital market activities (intermediary institutions, banks, asset management companies and investment trusts) or between such Association members and their clients and which may entail clients’ claims for damages, losses and compensation. Ever since its establishment, the arbitration committee received 363 applications in total, 187 of which were submitted directly and the remaining 176 via the CMB. As of year-end 2017, 129 of these applications were decided, out of which 17 were challenged and 13 were finalized. 79 applications are in the process of being reviewed by the arbitration committee and 78 others are awaiting for review by the arbitration committee. Moreover, 48 applications were settled and thus withdrawn, whereas 29 others were rejected. Oversight and Dispute Resolution Inquiries 50 TCMA 2017 Annual Report
